Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Forge by DWA CRM (the “Service”), provided by Digital Web Automations (“Digital Web Automations”, “we”, “us”). By creating an account or using the Service, you agree to be bound by these Terms.

Effective date: May 7, 2026.

1. The Service

Forge by DWA CRM is a software-as-a-service platform that lets users compose, schedule, publish, and analyse content across third-party social media platforms (the “Connected Platforms”), and that uses third-party large language models (“LLM Providers”) to assist with content generation. The Connected Platforms and LLM Providers are independent third parties; we provide an integration layer, not the underlying social-media or AI services.

2. Eligibility & Accounts

To use the Service you must (a) be at least 18 years old or the age of majority in your jurisdiction, (b) have the legal capacity to enter into these Terms, and (c) not be barred from using the Service under applicable law. You are responsible for the accuracy of the information in your account, for keeping your password secure, and for all activity that happens under your account.

3. Your Content

You retain all rights to the content you upload, generate via the Service, or schedule for publication (your “Content”). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, display, and modify your Content solely as needed to operate the Service on your behalf — including transmitting it to the Connected Platforms and LLM Providers you instruct us to use. We do not claim ownership of your Content and will not use it to train models.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any law, including export-control, anti-spam, or intellectual-property law;
  • Publish content that is unlawful, defamatory, obscene, sexually explicit (as defined by the relevant Connected Platform), threatening, harassing, hateful, or that incites violence;
  • Impersonate any person or entity, or misrepresent your affiliation;
  • Send unsolicited bulk messages, run automated mass-engagement schemes, or otherwise violate the published policies of any Connected Platform;
  • Reverse-engineer, scrape, decompile, or attempt to derive source code from the Service except to the extent expressly permitted by applicable law;
  • Interfere with the operation of the Service, probe for vulnerabilities without prior written consent, or use the Service to attack any third-party system.

We may suspend or terminate access without notice for material breach of this section.

5. Connected Platforms

When you connect a third-party social-media account, you authorise us to act on your behalf via that platform’s API within the scopes you grant. Your relationship with each Connected Platform is governed by that platform’s own terms; we are not a party to that relationship and have no control over its availability, content moderation, or rate limits. We store the access tokens you provide encrypted at rest (AES-256-GCM) and use them only to perform actions you initiate inside the Service.

6. AI-Generated Content

Output produced by LLM Providers may be inaccurate, incomplete, biased, or otherwise objectionable. You are solely responsible for reviewing AI output before publishing it. You acknowledge that LLM Providers may have their own usage policies and content filters that we cannot override. We make no representation that any AI output is fit for a particular purpose.

7. Plans, Fees & Billing

Paid plans are billed in advance on a recurring basis through Stripe. By subscribing, you authorise recurring charges to your payment method. Fees are non-refundable except where required by law. We may change pricing on at least 30 days’ notice; the new price applies at your next renewal. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Free plans, if offered, may be modified or discontinued at any time.

8. Intellectual Property

The Service, including its software, design, branding, and documentation, is owned by Digital Web Automations and protected by intellectual-property law. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service as permitted by these Terms. No other rights are granted.

9. Suspension & Termination

We may suspend or terminate your access if (a) you breach these Terms, (b) we are required to do so by law, or (c) continued provision is no longer commercially reasonable. You may terminate your account at any time. On termination we will delete your account data within 30 days, except where retention is required by law.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, Digital Web Automations DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Digital Web Automations WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD 100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold Digital Web Automations, its affiliates, officers, employees, and agents harmless from any claim, demand, loss, liability, or expense (including reasonable attorney’s fees) arising from (a) your Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any third-party right, including intellectual-property and privacy rights.

13. Changes to the Service or Terms

We may modify the Service and these Terms from time to time. Material changes to the Terms will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Digital Web Automations is domiciled, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the competent courts of that jurisdiction. Nothing in this section limits any consumer-protection rights you may have under mandatory local law.
